Americas Marriott Bonvoy™ Double Take Events Group Offer Terms and Conditions
1. Eligibility: Americas Marriott Bonvoy™ Double Take Events Group Offer (the “Promotion”) is open to Group Meeting Planners located in the United States, Caribbean, Latin America and Canada (excluding Prince Edward Island) who are 18 years of age or older as of March 5, 2019 (“Eligible Planners”). Eligible Planners include meeting and event planning professionals who are members of Marriott Bonvoy and are eligible to earn points through the Rewarding Events program. Employees, officers and directors of Marriott International, Inc. (“Sponsor”), Don Jagoda Associates (“Administrator”), or any of their respective parents; affiliates; subsidiaries; franchisees; mandataries; representatives; consultants; contractors; legal counsel; advertising, public relations, promotional, fulfillment, and marketing agencies; web site providers; web masters; and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household (whether or not related) are not eligible to participate. Void in Prince Edward Island and where prohibited or restricted by law. Subject to all applicable laws and regulations.
2. Sponsor & Administrator: The Sponsor is Marriott International, Inc., 10400 Fernwood Road, Bethesda, MD 20817 USA. The Administrator is Don Jagoda Associates, Inc., 100 Marcus Drive, Melville, NY 11747 USA.
3. How to Earn Double Points: March 5, 2019, through August 31, 2019 (“Promotion Period”), Eligible Planners may earn double Marriott Bonvoy™ points (“Points”) when they book meetings or events at one of the participating Marriott International hotels in the U.S., Canada, and the Caribbean and Latin America (“Participating Property”). Events must be held by December 31, 2020, to be eligible for the Promotion. The Eligible Planner will receive double Points for every event or meeting booked, up to a maximum of 200,000 Points per booking, if he or she is a member of the Marriott Bonvoy program. Double points are earned by the Eligible Planner upon actualization of the meeting or event. The Promotion is only valid on new bookings made during the Promotion Period. Promotion must be referenced at start of the negotiation process with the Participating Property for the meeting or event, and is not valid with any room blocks or events booked, under negotiation, or that occurred prior to March 5, 2019. Promotion cannot be combined with any other promotions. Blackout dates at Participating Properties may apply. Points have no cash value and cannot be redeemed for cash. The Eligible Planner must be a legal corporate entity with a valid tax ID number, business number or other equivalent documentation. In accordance with the laws of Foreign Corrupt Practices Act (FCPA), the Promotion and the earning of Points do not apply to government employees, officials, employees of State Owned Entities (“SOEs”) and those acting on behalf of government agencies, departments and SOEs when booking an event on behalf of their employing entity, as well as intermediaries when booking on behalf of a non-U.S. governmental entity or SOE. The Eligible Planner may also choose to donate his or her awarded points at https://giving.marriott.com.
4. General Conditions: Qualifying events must have a signed sales or catering contract, include the Loyalty account number on the contract, and be held at a participating hotel or resort. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor will donate the corresponding amount as of the date of cancellation (at least $50,000) unless the Promotion was never started. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected bookings; lost, interrupted, or unavailable network, server, or other connections; garbled transmissions or miscommunications; telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of booking will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
5. Release and Limitations of Liability: By participating in this Promotion, Eligible Planners agree that Sponsor and each of their respective parents; affiliates; subsidiaries; franchisees; representatives; consultants; contractors; legal counsel; advertising, public relations, promotional, fulfillment and marketing agencies; website providers; web masters; and their respective officers, directors, employees, representatives and agents (the “Released Parties”) are not responsible for: (1) any incorrect or inaccurate information, whether caused by Eligible Planners, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the booking process or the Promotion; (4) technical or human error that may occur in the administration of the Promotion or the processing of bookings; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from Eligible Planner’s participation in the Promotion. BY PARTICIPATING IN THIS PROMOTION, ELIGIBLE PLANNERS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THIS PROMOTION OR IN ANY PROMOTION RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY.
6. Jurisdiction: The Promotion and the Terms and Conditions are governed by the laws of the State of Maryland in the U.S. In the event of any dispute, Eligible Planners submit to exclusive personal jurisdiction in Maryland and agree that any dispute shall be brought in the U.S. for the U.S. District Court of Maryland.
7. Privacy: Information collected from Eligible Planners is subject to the Sponsor’s Privacy Policy, which can be found at www.marriott.com/privacy. Eligible Planners should be aware that Sponsor may be collecting nonpublic, personally identifiable information about them in connection with the operation of the Promotion.
